Rental Terms — KS‑MASKINER AS (Liftkongen)
1. Scope
These terms apply to the rental of equipment from KS‑MASKINER AS (hereafter “Lessor”) via liftkongen.no. The agreement is concluded between the Lessor and the Renter upon ordering or written acceptance. The order confirmation specifies the rental period, price, and any additional services.
2. Ordering and Payment
Orders are confirmed upon payment or written acceptance. Payment is made by card (Visa/Mastercard) or another specified payment method. The Lessor may require prepayment and reserves the right to perform a credit check.
3. Deposit
The Lessor may place a hold or pre-authorization on the Renter’s payment card. The deposit will be released within 14 days after correct and damage-free return, minus any claims for damage, cleaning, missing parts, or unpaid rental. Exact amounts and conditions are specified in the order confirmation.
4. Rental Period, Pickup, and Return
The rental period starts at pickup or the first day of delivery and ends upon return. Late returns are billed as a full day according to the price list in the order confirmation, plus any additional fees. Equipment must be returned to the agreed location and time in the same condition as at pickup, normally cleaned.
5. Cancellation and Changes
Cancellations or changes must be made in writing. Cancellation and change fees follow the order confirmation. Short-notice cancellations may result in full rental charges.
6. Operator Requirements and Training
Certain machines require a certified operator (e.g., lift license, forklift license). Requirements are specified in the product description or order confirmation.
The Renter is responsible for ensuring that operators have the necessary qualifications. The Lessor can provide training/introductory instruction for an additional fee — lack of training increases the Renter’s responsibility.
7. Handover Inspection and Documentation
Upon delivery, a handover inspection with a checklist is conducted. The Renter must sign and may take photos of the equipment. Any pre-existing damages must be documented in the handover protocol.
8. Usage Restrictions and Prohibitions
Equipment must not be modified or used for unintended purposes. Subletting is not allowed without written consent.
Use in explosive, corrosive, or other hazardous environments without explicit approval is prohibited.
9. Fuel, Batteries, and Return
Fuel-powered equipment must be returned with the same fuel level as at delivery unless otherwise agreed. Missing fuel will be charged according to current rates.
Batteries must be charged according to instructions. Incorrect charging or damage due to improper handling is the Renter’s responsibility.
10. Hour/Kilometer Tracking and Overuse
If there is an agreement on limited operating hours or mileage, any excess will be billed according to the order confirmation. Unauthorized overuse may result in additional charges and, in severe cases, rental termination.
11. Use, Maintenance, and Duties During Rental
The Renter must use equipment responsibly, following the manual and applicable laws and regulations.
The Renter is responsible for routine daily and weekly checks and maintenance that normally occurs during the rental period (e.g., visual inspection, lubrication, fluid levels, hose inspection, tire pressure, locks, and safety devices). Routine checks must be documented upon request.
For service needs during rental, the Renter must contact the Lessor before performing repairs, unless immediate action is necessary for safety.
The Renter is responsible for loss, damage, or theft caused by negligence or misuse. Normal wear and tear is not considered damage.
12. Insurance and Deductible
Full coverage applies only if the Renter has actively selected and paid for the Lessor’s insurance package. If the insurance package is chosen, the following applies:
- Full coverage is provided for damages, theft, and total loss during the rental period.
- Deductible per incident is NOK 10,000. The deductible may be charged to the Renter’s card immediately or upon the end of the rental.
- Insurance does not cover gross negligence, damages during transport/towing (loading, unloading, or transport), or violations of securing/loading rules. In such cases, the Renter is fully financially responsible.
If no insurance package is chosen, the Renter is fully financially responsible for all damages, theft, or loss of the rental equipment, up to the full value of the item, including repair costs, compensation, and lost rental.
Short text for checkout/product display: Optional full coverage — deductible NOK 10,000. Only applies if selected. Without insurance, the customer is fully liable for damage, theft, or loss.
13. Responsibility for Transport, Driver, and Tow Vehicle
The Renter is responsible for ensuring that the chosen tow vehicle/trailer is legally approved for towing the equipment (permissible trailer weight, hitch type, technical capacity, etc.).
The Renter guarantees that the driver has a valid license for the vehicle and trailer according to applicable traffic laws.
The Renter must comply with all traffic rules during transport and take necessary safety measures in case of hazard, damage, or inspection. Failure may result in full liability.
14. Theft
In case of theft, the Renter must immediately report the incident to the police and the Lessor, providing a copy of the police report.
The Lessor may require proof of proper storage and security. Lack of documentation may result in full liability even if insurance is purchased.
15. Damage and Complaints
Any faults or defects must be reported immediately. The Lessor will remedy faults at its discretion or replace equipment if appropriate.
Complaints must be submitted within a reasonable time after discovery. The Lessor is not responsible for indirect losses.
16. Deposit Handling and Claims
The Lessor may charge the Renter’s card for costs related to damage, cleaning, missing parts, unpaid rental, or deductible per insurance terms. The Renter may document and submit any counterclaims.
17. Cleaning and Additional Work
Equipment must be returned normally cleaned. Excessively dirty or contaminated units may incur cleaning fees or additional preparation costs according to the price list.
18. Limitation of Liability
The Lessor is not liable for indirect losses, lost profit, or consequential damages. Liability is otherwise governed by Norwegian law and these terms.
19. Force Majeure
A party is exempt from liability for events beyond its control, such as war, strike, natural disasters, government orders, or other unforeseen events preventing fulfillment.
20. Sanctions and Termination
The Lessor may recall equipment and terminate the agreement in case of material breach, non-payment, or safety concerns. Costs for recovery and lost rental may be charged to the Renter.
21. Documentation and Logging
The Lessor may require logs, operating hours, or other documentation for extended rentals. Photos from delivery and return may be used as evidence in case of claims.
22. Personal Data
The Lessor processes personal data for order management, payment, and contact purposes in accordance with applicable privacy laws. See our privacy policy for details.
23. Governing Law and Jurisdiction
The agreement is governed by Norwegian law. Disputes should be settled amicably; otherwise, the jurisdiction is Oslo District Court unless otherwise agreed.
